Regulatory collusion:
Collusion involves a conspiracy or tacit (and secret) agreement between parties. Absence of transparent processes can facilitate such 'back-room' agreements-between the regulatory and a stakeholder or between stakeholders. When such agreements are made in the open, they can be labeled as 'cooperation', as in the case of alternative dispute resolution.
