Some regulatory agencies utilize negotiated agreements in addition to (or instead of) rate cases with formal hearings. The outcome is viewed as acceptable by the regulatory authority if the negotiated settlement is supported by all the stakeholders, the public interest is adequately represented in the process, no part of the agreement runs counter to existing regulatory rules or previous decisions, and a factual record is developed to enable the agreement to be implemented.
